Dow, Jr: Upon review of the transcript of the status hearing held on 6/7/2019 [see 25-1], the parties' joint status report 25, and Plaintiff's requests for production [25-2], the Court directs that discovery and briefing on the sole issue presently ripe for decisionthe applicability of Section 1 of the FAAwill proceed as follows: (1) to the extent that Defendant has not already produced materials responsive to requests 1, 2, and 6, it must do so as soon as possible; (2) Defendant need not respond to requests 3, 4, 5, 7, 8, and 9 at this time as the requests are either not relevant to the limited issue for decision or so overbroad as to run afoul of the 2015 amendments to the Federal Rules of Civil Procedure directing courts (and parties) to consider whether requested discovery is "proportional to the needs of the case." These requests, as well as the proposed depositions, are not proportional to the needs of the case at this juncture. Briefing on the Section 1 issue will proceed as follows: (1) Defendant to file its supplemental brief by 7/16/2019; (2) Plaintiff to file her supplemental brief by 7/30/2019; (3) Defendant to file its reply, if any, by 8/6/2019.
