Due to the coronavirus pandemic, the Governor of New Jersey signed an executive order requiring that New Jersey's 2020 election be conducted though mail-in ballot (Executive Order 177). This lawsuit was part of a broader challenge to vote by mail procedures during the 2020 election. The Republican Committee in Monmouth County filed a notice of removal on October 5, 2020, in the U.S. District Court for the District of New Jersey, alleging that the Secretary of State Tahesha Way did not fulfill her official duties to promulgate rules and guidance in connection with the 2020 election. The federal court filing followed a lawsuit filed in New Jersey state trial court on September 24, 2020, seeking declaratory and injunctive relief in the form of compelling the Secretary of State to issue guidance on the procedures required under the Governor's executive order. The case was initially assigned to Judge Michael A. Shipp.
This case was dismissed without prejudice on October 23, 2020 and is now closed.
