The main plaintiff was an independent mayoral candidate in for Richmond, VA in 2016. He was informed by Richmond's General Registrar on June 21 (past the deadline) that he had failed to get the required 50 signatures in each of Richmond's 9 council districts, despite the fact that he had gotten the required 500 total signatures. Since he had only gotten 43 signatures of qualified voters in the Eighth district, he was disqualified. The plaintiff alleged that the Richmond Election Board had refused to consider evidence he held that would have shown the rejection of signatures to be unreasonable, a refusal he said was in violation of due process. The plaintiff then filed for a limited appeal hearing, which was required to be on June 27.

On August 23, 2016, the plaintiffs commenced filed a motion for temporary injunction in the Circuit Court for the City of Richmond against the Board Members for the City of Richmond. Plaintiffs alleged that such a compressed timeline, and the Board's refusal to consider certain evidence, violated their Due Process rights under the Virginia and US Constitutions, all of which was compounded by the facts that Virginia law and regulation placed the burden of proof on them, as opposed to the State and City, and that Board's decision was not appealable. 

On September 7, 2016, the case was removed to the Eastern District of Virginia. A complaint was filed the following day alleging the same facts. Plaintiffs sought a preliminary and permanent injunction requiring Defendants to recognize the validity of Signatory Plaintiffs' signatures on the Petition and requiring Schintzius name to be placed on the ballot; or, in the alternative, requiring Defendants to provide the due process review required by the 1st and 14th Amendments of the U.S. Constitution, and contemplated by applicable state constitutional and statutory law so that the arbitrary and capricious and unreasonable refusal to counter the signatures of qualified voters can be corrected. The same day, the plaintiffs filed a motion for a temporary restraining order. 

Defendants filed memoranda in opposition to the plaintiffs, explaining that even after the hearing, the plaintiffs were still four signatures short. They noted that the plaintiffs waited 54 days before filing suit, which they argued was dilatory and not diligent, which prejudiced them because relief would "require halting the entire election process for the City of Richmond" so he could have "what no other candidate received—a second chance to dispute rejected signatures . . . ."

On September 12, 2016, the judge, Hon. John Gibney Jr., denied the plaintiffs' request for a temporary restraining order and ordered a bench trial. The defendants then filed motions to dismiss for failure to state a claim that same day. 

Oral argument took place on September 13, 2016. On September 15, a bench trial occurred and Judge Gibney sided with the defendants. He dismissed the case with prejudice for all but one of the defendants, for whom he dismissed the case without prejudice. Judgment was entered the same day.
