Case Summary

(This summary is temporary while we research the case.) This case concerns a class action suit filed in the U.S. District Court for the District of Connecticut by and on behalf of military service members. Plaintiffs alleged that the Air Force discharged service members with "Other Than Honorable" or "General" service characterization due to misconduct attributable to post-traumatic stress disorder, traumatic brain injury, military sexual trauma, and other behavioral health conditions, and that individuals who received those discharges were systematically denied status upgrades by the Air force Discharge Review Board. The Air Force agreed to settle lawsuit.

The parties' 36 Joint Motion for Referral for Settlement Conference and for Extension of Time ("Joint Mot.") is GRANTED, nunc pro tunc, with the agreement of the parties and for good cause shown. The parties have requested referral for a settlement conference "to explore whether the case can be resolved before further costs and fees are incurred in additional discovery and motion practice." Joint Mot. 1. This Court similarly referred the companion cases of Kennedy v. McCarthy, No. 3:16-cv-2010 (CSH)(RMS), and Manker v. Modly, No. 3:18-cv-372 (CSH)(RMS), to United States Magistrate Judge Robert M. Spector for the purpose of considering settlement by the parties. See Kennedy, Order of Referral to Magistrate Judge, ECF No. 131; Manker, Mem. and Order of Referral, ECF No. 94. The similar discharge-upgrade claims at issue in Kennedy and Manker, and the parties' shared legal representation, favored referral of those two cases to the same Magistrate Judge. Kennedy, Order of Referral to Magistrate Judge, ECF No. 131 2-3. The same reasoning applies here, as the claims at issue and the parties' legal representation substantially overlap with those in both Kennedy and Manker. Accordingly, the Court will enter a separate order referring this case for a settlement conference before Judge Spector. The parties have also requested an extension of the deadline for (1) Defendants to file their response to Plaintiffs' class certification motion and (2) the parties to confer regarding discovery pursuant to Federal Rule of Civil Procedure 26(f). This request was made on the deadline of March 21, 2022, and not, as generally required by Local Rule 7, at least three business days earlier. D. Conn. L. Civ. R. 7(b)(3). However, as the parties consent to the motion and are actively engaged in "cooperative efforts to move towards settlement," Joint Mot. 2, the Court finds good cause to extend the deadline nunc pro tunc. Defendants must file their response to Plaintiffs' class certification motion on or before May 20, 2022.
