Case Summary

(This summary is temporary, while we research the case.) This lawsuit began in the Supreme Court of Niagara County, a New York state trial court, on April 10, 2012. The plaintiffs sued the City of Niagara Falls for its alleged failure to properly clean up Love Canal, a superfund site where chemicals were dumped throughout the 1900s. The plaintiffs alleged that chemicals from Love Canal had caused them health problems. Various similar suits were filed in subsequent years, until there were 19 suits in total. The cases were removed multiple times to federal court, but ultimately sent back to state court. In 2023, the court dismissed all the cases due to the speculative nature of the connection between the plaintiffs' health issues and Love Canal. The plaintiffs appealed, and the cases are ongoing.
