[This summary is temporary while we research the case]. This is a national injunction case. This is a case about the public's right to access deportation hearings in the aftermath of the September 11, 2001 terrorist attacks.
In 2002, a media corporation filed this suit against the Attorney General arguing that press and public have a First Amendment right to attend "special interest" deportation hearings that the government had closed. The district court ruled in favor of the plaintiffs, granting a preliminary injunction against the government's closure of hearings. The Third Circuit reversed the district court's opinion and dismissed the injunction.
