Case Summary

[This summary is temporary while we research the case further.] In 2023, South Carolina prohibited abortion care after a fetal heartbeat had been detected, with limited exceptions. On January 8, 2025, multiple South Carolina doctors filed a lawsuit challenging the prohibition in the U.S. District Court of South Carolina. Represented by The Lawyering Project and private counsel, plaintiffs sued the state Attorney General and the Solicitor in each judicial county. Plaintiffs asserted that, because their faiths instruct them to help a pregnant person end a potentially dangerous pregnancy, the abortion ban violated plaintiffs' free exercise rights under the First Amendment. Plaintiffs also alleged that the statute was unconstitutionally vague.
