(This summary is temporary, while we research the case.) On March 6, 2025, two Pennsylvania school districts and five parents filed this lawsuit in the Commonwealth Court of Pennsylvania. They named the Office of the Governor and the Pennsylvania Human Relations Commission as Defendants. They challenged a 2023 decision by Defendants to define "sex" under state law to include gender identity. The Plaintiffs alleged that Defendants exceeded their authority under the Pennsylvania Constitution, arguing that only the Pennsylvania legislature had the authority to make such policy changes.
