On April 21, 2025, an international student—attending school on an F-1 visa--filed this lawsuit in the United States District Court for the Northern District of Illinois against the Department of Homeland Security and its Secretary and Immigration and Customs Enforcement and its Acting Director. In early April, the Defendants abruptly terminated the Plaintiff’s, and other international students’, F-1 visa and records with the Student and Exchange Visitor Information (SEVIS), effectively stripping them of their ability to remain a student in the United States. The Plaintiff alleged that Defendants' actions were unlawful and designed to coerce them and other international students into abandoning their studies and self-deporting. The Plaintiff alleged that Defendants’ actions violated the Administrative Procedure Act.

District Judge Angel Kelley: ORDER GRANTING PLAINTIFF'S MOTION FOR TEMPORARY RESTRAINING ORDER entered. Following a hearing with counsel, the Court GRANTS Plaintiff’s request for a temporary restraining order. The Defendants are ORDERED to temporarily set aside their determination that the Plaintiff's F-1 student status is terminated. The Defendants shall restore his student status and SEVIS authorization, retroactive to April 8, 2025.
