This case is one of numerous lawsuits challenging the Trump administration’s abrupt termination of immigration visas—mostly student or work visas—with no notice to the visa-holders and with dubious or no legal basis. You can see all of the cases here.

(This summary is temporary, while we research the case.) On April 24, 2025, four international students—attending school on an F-1 visa--filed this class action lawsuit in the United States District Court for the District of Connecticut against the Department of Homeland Security, the Secretary of Homeland Security, and the Acting Director of Immigration and Customs Enforcement. In early April, the Defendants abruptly terminated the Plaintiffs', and other international students’, F-1 visa and records with the Student and Exchange Visitor Information (SEVIS), effectively stripping them of their ability to remain a student in the United States. The Plaintiffs alleged that Defendants' actions were unlawful and designed to coerce them and other international students into abandoning their studies and self-deporting. The Plaintiffs alleged that Defendants’ actions violated the Administrative Procedure Act and the Fifth Amendment.

However, insofar as Defendants argue that conversion into a preliminary injunction of the Temporary Restraining Order at ECF No. 17 is unnecessary because "Plaintiffs are no longer likely to suffer" immediate irreparable harm now that Defendants have reactivated Plaintiffs' SEVIS records, see ECF No. 25 at 2, that position appears to rest on a representation that United States Immigration and Customs Enforcement ("ICE") has "no plans" to repeat its original action on the same original basis, ECF No. 25 at 3. ORDER granting ECF No. 34, Motion for Extension of Time. For the reasons stated, good cause exists to grant this motion. Relatedly, the court thanks Defendants for their candor in explaining that in reaching out to opposing counsel, they unintentionally had neglected to specify the length of the extension to be requested. The court finds the request to be reasonable, and also notes that Plaintiffs have not docketed any objection since the instant June 24 motion (which included this explanation) was filed. As such, Defendants shall file a response to the complaint on or before August 11, 2025. Additionally, the motion reports that the parties are engaged in good faith negotiation at this time.
