(This summary is temporary, while we research the case.) On April 24, 2025, an international student—attending school on an F-1 visa--filed this lawsuit in the United States District Court for the Eastern District of New York against President Donald Trump, the Secretary of Homeland Security, and the Acting Director of Immigration and Customs Enforcement. In early April, the Defendants abruptly terminated the Plaintiff’s, and other international students’, F-1 visa and records with the Student and Exchange Visitor Information (SEVIS), effectively stripping them of their ability to remain a student in the United States. The Plaintiff alleged that Defendants' actions were unlawful and designed to coerce them and other international students into abandoning their studies and self-deporting.

Diana Mahoney appeared on behalf of Defendants. The parties' status reports were discussed. See ECF Nos. 11 and 12 . For the reasons stated in Plaintiff's report, see ECF No. 11, the parties jointly requested to hold the Preliminary Injunction ("PI") briefing in abeyance. Although Defendants neither agreed to nor stipulated to a corresponding extension of the Temporary Restraining Order ("TRO"), see ECF No. 8, and Defendants' opposition to such extension was noted on the record, because all parties jointly requested to hold briefing on the PI motion in abeyance, the Court granted said request and necessarily ordered that the TRO remain in effect until resolution of the PI motion in order to facilitate said request. The Court explained that this was the only way it could maintain the status quo, which it found to be necessary under the circumstances of this case, while also allowing the PI briefing to remain in abeyance. Finally, the Court directed the parties to meet and confer and to submit by May 6, 2025, a joint status update, and for Defendants to make available to Plaintiff a copy of the updated visa revocation policy.
