The same day, the plaintiff filed a motion for a temporary restraining order (TRO). The court scheduled expedited briefing and a hearing. On April 21, 2025, the court granted the TRO, ordering ICE to restore the plaintiff’s SEVIS record to “active” status and enjoining the agency from modifying that status based on the same underlying arrest.

The plaintiff subsequently moved for a preliminary injunction (PI) on April 25, seeking to preserve that relief through the duration of the litigation. The government opposed, arguing the case was moot or that the plaintiff lacked irreparable harm. After an evidentiary hearing on May 5, the court denied the motion on May 14, 2025. Although the court agreed the initial SEVIS termination was likely unlawful, it found the plaintiff could not demonstrate irreparable harm given the government’s sworn declarations and assurances that her SEVIS record had been retroactively restored, would not be terminated absent new information, and that she remained in lawful status. The court noted the plaintiff could seek emergency relief if those representations were violated.

On June 4, 2025, the plaintiff filed a motion for summary judgment and on June 25, defendants moved to dismiss. Neither filing is publicly availalble. The case remains ongoing.

MINUTE ORDER: Pursuant to Local Rule 7(n)(1), the Court ORDERS the Government to file the administrative record in this case along with its opposition to the Plaintiff's motion for preliminary injunction. The administrative record is necessary at this stage so the Court can review the full record before the agency at the time it made its decision and make a reasoned and considered decision in this case. That is precisely why the D.C. Circuit has held that district courts must "require[] the [agency] to file the administrative record" "before assessing [the] probability of success on the merits" for an Administrative Procedure Act (APA) claim on a preliminary injunction motion. Am. Bioscience, Inc. v. Thompson, 243 F.3d 579, 582 (D.C. Cir. 2001). The Government states in the 16 Joint Status Report that it does "not intend to lodge any administrative record prior to the hearing" in part because it has "raised threshold jurisdictional defenses under the Privacy Act that do not require the Court to consider any materials beyond the complaint or any documents either attached to or incorporated by reference in the complaint." ECF No. 16 at 2. But the Court is satisfied that it has jurisdiction in this case. It has already preliminarily rejected the Government's jurisdictional arguments when it granted the Plaintiff temporary injunctive relief. And it has since carefully considered those arguments and determined that they are without force. The Government argues that it has not waived sovereign immunity under Section 702 of the APA because, in its view, the "Plaintiff's claims sound in the Privacy Act," ECF No. 7 at 13, which "expressly or impliedly forbids the relief which is sought," id. at 12 (cleaned up). The Plaintiff's claims plainly do not sound in the Privacy Act. And "[w]hen a statute is not addressed to the type of grievance which the plaintiff seeks to assert, then the statute cannot prevent an APA suit." Match-E-Be-Nash-She-Wish Band of Pottawatomi Indians v. Patchak, 567 U.S. 209, 216 (2012) (cleaned up). If the Government is unable to file the administrative record by May 2, 2025, it should file a notice by April 28, 2025, advising the Court of (1) why it cannot meet that deadline; (2) when it anticipates being able to file the administrative record; and (3) whether it consents to the Court extending the 12 Temporary Restraining Order entered on April 21, 2025, until the Government files the administrative record and the Court has had an opportunity to rule on the motion for preliminary injunction in light of that record. MINUTE ORDER: The Government filed a Notice in a similar case before this Court representing that it had conveyed three representations to the Plaintiff's counsel in that case: (1) that ICE "has no plans under its new [SEVIS] policy to re-terminate [the Plaintiff's] SEVIS record [based] solely on the NCIC record that led to the termination last month"; (2) that "ICE views the reactivation of [the Plaintiff's] record to have retroactive effect to the date of the earlier termination, i.e., ICE takes the view that there is no 'gap' or 'lapse' in [the Plaintiff's] SEVIS record"; and (3) that "ICE intends to provide [the Plaintiff] with a letter regarding the retroactive effect of the SEVIS record reactivation so that [the Plaintiff] can provide that letter to [USCIS] or any other government official to alert such officials to ICE's position on the retroactivity of the reactivation." MINUTE ORDER: The Court held a hearing in a similar case earlier today, during which the Government represented that it "will not terminate [the Plaintiff's SEVIS record] absent new information." Khademi v. Noem, 25-cv-1206, Motions H'rg (May 9, 2025), Rough Draft Tr. at 6:2-3 (emphasis added). The Court asked the Government to confirm that statement: "You're saying to this Court that you will not terminate?" Id. at 6:4-7. The Government responded: "Absent new information, yes, Your Honor." Id. at 6:8-9. The Court ORDERS the Government to file a notice by May 12, 2025, addressing: (1) whether it is willing to make the same representation as to Ms. Bushireddy; and (2) whether Ms. Bushireddy's visa revocation, Watson Decl. 8, ECF No. 7-1, is the type of visa revocation that the Government's new SEVIS policy contemplates as a basis for SEVIS revocation, see SEVIS Notice, ECF No. 20-1 ("If State revokes a nonimmigrant visa effective immediately, SEVP may terminate the nonimmigrant's SEVIS record based on the visa revocation with immediate effect[.]"). MINUTE ORDER denying the Plaintiff's 17 Motion for Preliminary Injunction. A preliminary injunction is "an extraordinary remedy that may only be awarded upon a clear showing that the plaintiff is entitled to such relief." Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 22 (2008). "[I]f a party makes no showing of irreparable injury, the court may deny the motion for injunctive relief without considering the other factors." Henke v. Dep't of Interior, 842 F. Supp. 2d 54, 59 (D.D.C. 2012) (cleaned up). As the Court made clear on the record when granting the 2 Motion for Temporary Restraining Order, ECF No. 12, the Government's hasty termination of the Plaintiff's Student and Exchange Visitor Information System (SEVIS) record appears unreasoned and unlawful. The Court therefore (1) ordered the Government to return the Plaintiff's record in SEVIS to the "Active" status, and (2) ordered that the Government may not change or otherwise modify the Plaintiff's record in SEVIS based on the same information that led to the termination. The Plaintiff now requests a preliminary injunction from the Court ordering the same relief for the duration of this litigation. But the Government has made written and oral representations to the Court that make a preliminary injunction unnecessary. First, the Government submitted a sworn 32 Declaration stating that it has set Ms. Bushireddys "SEVIS record back to 'active'" and that "there are no 'gaps' or 'lapses' in the SEVIS record." Decl. of James Hicks para. 3, ECF No. 32-1. The Court is perplexed and troubled by the Government's representation that because of "technical limitations of the SEVIS system," certain notations about retroactivity "are not viewable by end-users outside of SEVP," id. para. 4, but the Government has assured this Court in a written 36 Response that it will provide Ms. Bushireddy with "a letter regarding the retroactive effect of the SEVIS record reactivation," Response to Court Order at 1, ECF No. 36. Second, the Government has represented in a written 37 Response that "it will not terminate [Ms.] Bushireddy's SEVIS record absent new information," and that "a visa revocation that is effective upon departure" (i.e., the type of visa revocation that applies to Ms. Bushireddy) "is not, in itself, a basis for termination of the SEVIS record under the new SEVIS policy." Response to Court Order at 2, ECF No. 37. And third, the Government has represented in a written 24 Notice that "ICE understands that Plaintiff is presently in lawful nonimmigrant status in the United States." Notice of Filing at 1, ECF No. 24. In light of these representations, the Plaintiff cannot establish irreparable harm in the absence of preliminary relief from this Court. Indeed, the Government's representations mirror the relief the Plaintiff asks this Court to order and therefore make a preliminary injunction unnecessary. Should the Government terminate Ms. Bushireddy's SEVIS record again in contravention of any of its written or oral representations to this Court, Ms. Bushireddy may seek further emergency relief, and the Court assures the Parties that it will act expeditiously.The Court ORDERS the Parties to meet and confer and to submit a proposed schedule by May 21, 2025, for further proceedings in this case.
