(This summary is temporary, while we research the case.) On April 14, 2025, an international student—attending school on an F-1 visa--filed this lawsuit in the United States District Court for the Northern District of Alabama against the Acting Director of Immigration and Customs Enforcement. In early April, the Defendants abruptly terminated the Plaintiff’s, and other international students’, F-1 visa and records with the Student and Exchange Visitor Information (SEVIS), effectively stripping them of their ability to remain a student in the United States. The Plaintiff alleged that Defendants’ actions violated the Administrative Procedure Act.

TEXT ORDER: This matter is set for a hearing on April 28, 2025 at 3:00 p.m. to address Ms. Kshatri's motion for a TRO. In her complaint, Ms. Kshatri alleges that she is a citizen of India who is attending the University of Alabama at Birmingham and that she has been informed that her SEVIS record has been terminated based on a criminal records check and/or because of the revocation of her student visa. (Doc. 1 ). In her complaint, Ms. Kshatri relates information about what appears to be a misdemeanor charge against her that has been dismissed. (Doc. 1, p. 3; see also Doc. 2, pp. 5, 18). Before Ms. Kshatri provides information concerning this allegation in a hearing, the Court will make available to Ms. Kshatri an attorney from the Office of the Federal Public Defender for the Northern District of Alabama so that Ms. Kshatri has the opportunity, if she wishes, to consult with an attorney about materials relating to the alleged dismissed charge before Ms. Kshatri places those materials in the record. An attorney for the Federal Public Defender's Office shall please attend the April 28, 2025 hearing in this matter.
