Jordin Alexander Melgar-Salmeron is an undocumented immigrant who had been in immigration detention since 2022 following a prison sentence for possessing an unregistered shotgun. In January 2024, the Biden Administration placed his deportation case on hold amid broader litigation over immigration policy.

Melgar-Salmeron filed this petition for review in the U.S. Court of Appeals for the Second Circuit, challenging a Board of Immigration Appeals decision that upheld an immigration judge’s denial of his applications for withholding of removal and protection under the Convention Against Torture. He is represented by attorneys Matthew K. Borowski and Daniel Edward Jackson.

On April 17, 2025, the Trump Administration moved to expedite Melgar-Salmeron’s deportation case and removal. The Department of Justice (DOJ) indicated that it sought to deport him by May 9 “at the latest,” but assured the court that no deportation would occur before May 8. In response, the petitioner moved for emergency relief and requested that the government be enjoined from removing him. On May 7, the court denied the government's motion and granted the petitioner’s request for emergency relief.

Despite the court’s order, Melgar-Salmeron was placed on an ICE Air flight to El Salvador just 28 minutes later. The next day, the government notified the court of his removal, attributing it to a “confluence of administrative errors” that caused ICE to miss the court’s order. He is at least the fourth person removed despite a federal court order barring removal. Although the government initially agreed to parole him back into the United States if he presented at a port of entry, it refused to disclose his current location, preventing the court from assessing the adequacy of that remedy.

On June 24, 2025, the court ordered the government to facilitate his return and to report within a week on:

  1. The petitioner’s current location and custodial status; and
  2. The steps it would take to secure his return.

The government responded with a letter and a signed declaration stating that the petitioner was in custody at the Terrorism Confinement Center in Telocula, El Salvador. On July 11, the court ordered the government to file weekly declarations informing the court of the petitioner’s location and the steps being taken to facilitate his return. As of August 4, the government has complied with these weekly updates.

On September 8, the court ordered the parties to meet and confer regarding steps that could facilitate further proceedings. The court also directed the government to file a declaration detailing what measures had been taken to facilitate communication between the petitioner and his counsel.

Following that order, the court sent a diplomatic note to the Salvadoran Ministry of Foreign Affairs, again requesting that the Ministry facilitate communication between the petitioner and his U.S. counsel. The government reported that the Salvadoran Directorate of Prisons communicated to the U.S. Embassy its willingness to accommodate a video call between the petitioner and his attorneys “in short order.” However, a few days later, the government informed the court that the Ministry stated that future communication between the petitioner and his counsel would require a petition for assistance in criminal matters under Article 7(b) of the Inter-American Convention on Mutual Assistance in Criminal Matters.

The case remains ongoing.
