This case challenges allegedly unsafe and unconstitutional conditions of confinement faced by a family of immigrant detainees. The petitioners, N. M. Z., D. M. Z., and Ms. Z., were detained pending expedited removal proceedings due to their immigration status.

On June 24, 2025, the petitioners filed this lawsuit in the U.S. District Court for the Western District of Texas against the warden of the Dilley Immigrant Processing Center, U.S. Immigration and Customs Enforcement (ICE), and the Acting Field Office Director of San Antonio ICE. The petitioners brought claims under 28 U.S.C. § 2241, the Rehabilitation Act of 1973, and the Administrative Procedure Act. Represented by private counsel, the petitioners sought a preliminary injunction for their release from custody pending final judgment and a stay of their removal. Judge Samuel Frederick Biery presided over the case.

The sealed complaint and habeas petition alleged that continued incarceration subjected the petitioners to serious harm, including inadequate medical care and unsafe conditions, in violation of constitutional protections of human dignity. They further argued that expedited removal procedures denied them adequate notice and opportunity to be heard, in violation of the Rehabilitation Act and the Administrative Procedure Act.

The court issued an Order to Show Cause on June 26, 2025. However, on July 7, 2025, the petitioners filed a joint stipulation of dismissal. The case was terminated on July 7, 2025.

Text Order GRANTING 13 Elora Mukherjee's Motion to Appear Pro Hac Vice. It is this Court's policy to require all counsel to apply for admission to the Western District's federal bar and to follow through with the application as a condition of appearance pro hac vice in any case. This Court, however, has made an exception for counsel if their practice in the District is limited to one case and, in limited circumstances, a licensed Western District of Texas attorney is involved in the case as co-counsel. Here, counsel has not made previous appearances in the Western District of Texas and a licensed Western District of Texas attorney has been designated as co-counsel in this case. Therefore, counsel may appear in this case pro hac vice without seeking admission to practice in the Western District of Texas, although counsel is free to seek and is encouraged to seek admission if that is desired. Any future appearance in the Western District of Texas will require that counsel apply for admission and be admitted into this District, unless otherwise ordered by the Court. The Court further ORDERS that counsel must become familiar with the Local Court Rules of the United States District Court for the Western District of Texas, a copy of which may be obtained from the United States District Clerk for the Western District of Texas or from the Court's website. Finally, IT IS FURTHER ORDERED that counsel appearing pro hac vice, pursuant to Section 6 of the Administrative Policies and Procedures for Electronic Filing in Civil and Criminal Cases in the Western District of Texas, must register as a filing user within ten (10) days of this Order. Entered by Judge Richard B. Farrer. (This is a text-only entry generated by the court. There is no document associated with this entry.) (cslc)
