In the wake of Dobbs v. Jackson Womens' Health Organization, independent abortion providers have faced immense pressure to deliver safe, accessible abortion care, especially via medication abortion, which is safer, more accessible, and preferred by many patients. Among these abortifacent medications is Mifepristone, which is subject to the FDA's pre-2016 Risk Evaluation and Mitigation Strategies (REMS) program, thus creating substantial barriers to the drug's distribution.

On May 8, 2023, a coalition of independent abortion providers filed suit against the FDA, the Department of Health and Human Services (HHS), and Xavier Becerra, in his official capacity as Secretary of the Department of Health and Human Services, seeking declaratory judgment pursuant to 28 U.S.C. § 2201, that mifepristone is safe and effective and that Defendants’ approval of mifepristone is lawful and valid. Plaintiffs also sought to enjoin defendants from applying REMS to mifepristone, pursuant to 28 U.S.C. § 2202.

This case is ongoing.
