On November 6, 2025, plaintiff, a. U.S.-based importer and distributor of merchandise, filed suit against U.S. Customs and Border Protection in the U.S. Court of International Trade. The complaint states that President Trump invoked the International Emergency Economic Powers Act (“IEEPA”) as authority to impose new and substantial tariffs (“IEEPA duties”) on goods imported from nearly every foreign country, including countries from which Plaintiff sourced its imports. Plaintiff is responsible for paying these tariffs on its imported goods. Plaintiff alleges that IEEPA does not authorize these tariffs.
