On November 6, 2025, Netuno USA, Inc. filed suit against the Trump administration to challenge their imposition of tariffs on imported merchandise, and modified tariff rates, timing, and scope. Plaintiffs allege that the national emergencies declared by the President do not constitute “unusual and extraordinary threats” within the meaning of International Emergency Economic Powers Act (IEEPA). Instead, they rest on ordinary economic conditions—such as trade deficits and foreign competition—that have existed for decades and cannot plausibly justify emergency action. The President’s reliance on IEEPA to unilaterally impose tariffs is therefore unlawful.
