On November 10, 2025, Plaintiff - a U.S. based importer of tires - filed this lawsuit in the U.S. Court of International Trade against U.S. Customs and Border Protection, commissioner Rodney Scott, and the United States. This lawsuit arose following President Trump's invocation of the International Emergency Economic Powers Act (IEEPA), through which he claimed authority to impose sweeping duties on nearly every foreign country. Plaintiff sought a declaration that IEEPA duties are unlawful, an injunction barring Defendants from further imposition of said duties, and a refund of all duties already paid.
