Plaintiffs, a Delaware-incorporated U.S. importer, brought this lawsuit in the U.S. Court of International Trade against United States Customs and Border Protection, Rodney S. Scott, and the United States to challenge President Trump's 2025 IEEPA tariff regime. The complaint alleged that a series of Executive Orders issued in early 2025 drastically increased its import costs and forced reclassification of merchandise under modified HTSUS codes. Plaintiffs argued that Congress holds the sole constitutional authority to impose tariffs, and that IEEPA’s language regulating property interests and financial transactions cannot be stretched to authorize duties. Filing under the ultra vires doctrine, and, alternatively, under Article I § 1 and § 8 of the U.S. Constitution, Plaintiffs asked the court to declare the tariffs unlawful, enjoin CBP from further collection, suspend liquidation, and refund all IEEPA-based duties.
