On November 11, 2025, Plaintiff, a Michigan-based importer, brought this suit against the United States Customs and Border Protection Agency, Rodney S. Scott, and the United States in the U.S. Court of International Trade. Plaintiffs sought to challenge President Trump’s 2025 IEEPA-driven tariff regime. The complaint charged that escalating tariffs on Mexico, Canada, China, and nearly all other trading partners, including reciprocal tariffs raised as high as 125%, forced importers to pay dramatically higher duties. Plaintiffs stressed that, under V.O.S. Selections v. Trump, CBP has no authority to collect said duties. Plaintiffs sought declaratory relief, an injunction halting further tariff collection, suspension of liquidation, and reimbursement of all IEEPA-based duties paid.
