On November 10, 2025, Plaintiff, a U.S. manufacturer and importer, sued CBP over the Trump Administration's IEEPA-based tariff regime. Its complaint alleged that the February 2025 “Trafficking Tariff Orders,” duties related to Chinese opioids, and the large “Reciprocal Tariff” expansion imposed undue burdens on imports, forced needless reclassification, and disrupted supply chains. Plaintiffs argued that appellate courts have already held these executive orders unlawful under V.O.S. Selections v. Trump. Plaintiff requested a declaration invalidating the tariffs, an injunction against further collection, suspension of liquidation, and full refunds.
This case is one of several dozen that were consolidated with AGS Company Automotive Solutions v. United States Customs and Border Protection, the lead case regarding IEEPA duty liquidation as of December 3, 2025. On December 23, that case was stayed pending the Supreme Court's decision in V.O.S.
