On December 4, 2025, Plaintiff, a U.S. importer subjected to the challenged duties, brought this lawsuit in the U.S. Court of International Trade against U.S. Customs and Border Protection and its commissioner, as well as the United States, in order to challenge a suite of allegedly unlawful Trump Administration tariff orders. The "IEEPA orders" dramatically raised the cost of machinery and components sourced globally, pursuant to a series of 2025 executive orders issued by the Trump administration. Plaintiff argued that the tariffs exceeded the President's authority, and sought declaratory and injunctive relief, damages, fees and costs.
On December 23, that case was stayed pending the Supreme Court's decision in V.O.S. Selections v. Trump. For more IEEPA litigation in the Clearinghouse collection, see here.
