IT IS FURTHER ORDERED that on or before 11/07/25, Respondents shall provide a list of how the sources of the requested information for each detainee are stored, accessed, and maintained, including but not limited to any arrest warrant, NTA, Form-286, and Form I-213, whether stored electronically, within the E-Cast system, or otherwise. Respondents shall also provide an exemplar of how these documents are stored for an individual detainee for the Courts review. IT IS FURTHER ORDERED that a status conference is set for 11/13/25 at 10:30 a.m., in LV Courtroom 7C, in all three putative class actions. IT IS FURTHER ORDERED that at least one representative from DHS/ICE who can describe how the agency identified the 185 detainees and how the requested information is stored, maintained, and retrieved shall appear at the 11/13/25 status conference. ORDER. IT IS ORDERED that Plaintiffs' 18 Motion for Preliminary Injunction is GRANTED. Defendants are ORDERED to: (1) IMMEDIATELY RELEASE no later than 7:00 p.m. on November 24, 2025. Plaintiff's release will be subject to the b ond conditions imposed by IJ Daugherty. Plaintiff Jacobo-Ramirez will have until December 5, 2025, to satisfy the bond conditions. If he fails to do so, he will be subject to rearrest and redetention under 8 U.S.C. § 1226(a). (2) PROVIDE Pla intiff Guevara-Alcantar with a bond hearing pursuant to 8 U.S.C. § 1226(a) and its implementing regulations within seven (7) days, no later than December 1, 2025. If the individualized bond hearing is not conducted by December 1, 2025, Plaintif f shall be RELEASED until it is determined that his detention is warranted under 8 U.S.C. § 1226(a). IT IS FURTHER ORDERED that Defendants are ENJOINED from denying Plaintiffs release on bond on the basis that they are subject to mandatory detention pursuant to 8 U.S.C. § 1225(b)(2). MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 12/4/2025.The Court has reviewed the 41 Joint Status Report filed by the parties in compliance with this Court's 35 Order. The Court is alarmed to learn that Plaintiff Guevara-Alcantar was ordered released on bond December 1, 2025 by IJ Daughtery, but remains in detention despite multiple attempts by his family members to pay the bond using ICE's online portal, when after each attempt they received an error message stating "there are no matching or no releasable aliens for this bond payment request." See ECF No. 41 at 3. Defendants assert that bond must be paid in person due to unspecified "limitations on disclosure of information due to privacy issues which prohibit acceptance of the bond online" and additional information regarding these privacy issues has been requested by Plaintiffs' counsel. Id.The Court finds that Defendants' failure to expediently accept the bond payment by Plaintiff Guevara-Alcantar is unlawfully prolonging his detention. This prolonged detention is inconsistent with the Court's intent in its 35 Order that Plaintiff Guevara-Alcantar be released immediately upon the granting of bond.Therefore, IT IS HEREBY ORDERED that Mr. Guevara-Alcantar be IMMEDIATELY RELEASED from Defendants' custody. Mr. Guevara-Alcantar shall have until January 19, 2025 to satisfy the bond conditions. IT IS FURTHER ORDERED that Defendants shall file a notice of compliance with this Order no later than 5:00 p.m. TODAY, December 4, 2025. Crtrm Administrator: D Smith; Pla Counsel: Sadmira Ramic, Michael Kagan My Khanh Ngo, Andrew Elkins, Daniel Lippman and Karen Monnreal; Def Counsel: Virginia Tomova and Christian Ruiz; Court Reporter: P Ganci; Time of Hearing: 9:18 - 10:38; Courtroom: 7C Parties present as represented above. The Court makes preliminary remarks and hears from the parties as to the 15 Motion to Certify Class and 39 Response to Petition/Class Action Complaint. The matter is taken under advisement, and a written Order shall issue. The Court notes that if the class is certified, the Court expects, for the reasons stated on the record, to order an expedited briefing schedule on partial summary judgment. If a class is certified, the Court further instructs Plaintiffs to file any request for notice to class members upon certification pursuant to Fed. R. Civ. Proc. 23(c)(2)(A). The Court hears from the parties as to the status of Court ordered discovery. Counsel will execute the 34 Protective Order. IT IS ORDERED that on or before 4:00 pm on Monday, 12/22/2025, consistent with the Courts previous orders, Defendants shall provide a list of all detainees in ICE custody, including their name, A-number, and country of origin, in the District of Nevada who are not subject to a final order of removal. Failure to comply with this order may result in sanctions. IT IS FURTHER ORDERED that Defendants shall provide this same updated list to opposing counsel on EVERY Monday by 4:00 pm starting today until the Court orders otherwise. IT IS FURTHER ORDERED after the detainee list is produced to Plaintiffs counsel, the parties shall meet and confer regarding a schedule for the production of the remaining related documents consistent with the Courts previous orders. The parties shall file a joint status report as to the schedule of the production of the related documents by December 30, 2025. If there is no agreement as to the timing of the production the status report should indicate the positions of the parties.
