Plaintiffs Adrian James Noriega and Darius Latrell Richardson originally pursued this case as a class action, but they notified the Court on December 11, 2025, that they "intend to timely file for leave to amend to remove the Class Action allegations from the original complaint." Doc. 28, Notice, para. 7. The Court thereafter ordered Plaintiffs to file an amended complaint removing class allegations by February 9, 2026, and set the deadline to otherwise amend pleadings as March 12, 2026. See Doc. 29, Second Am. Scheduling Order, 3. Both deadlines have passed, and Plaintiffs have not amended their complaint.
