On January 30, 2026, the State of Missouri and four individual Missouri voters filed this lawsuit against the U.S. Department of Commerce and Census Bureau to challenge the inclusion of illegal immigrants and temporary visa holders in the U.S. Census for apportionment purposes. Plaintiffs contend that the 14th Amendment's phrase "whole number of persons in each State" should be interpreted to mean only people who are legally domiciled in a state, specifically citizens and legal permanent residents. Filing under the 14th Amendment and Article II of the U.S. Constitution, as well as the Administrative Procedure Act, Plaintiffs sought a declaration that including illegal aliens/temporary visa holders violates the Constitution; an order to redo 2020 Census and 2021 apportionment excluding these groups; an injunction preventing their inclusion in 2030 Census; and a three-judge panel required under 28 U.S.C. § 2284.
