Filed March 9, 2026 in the U.S. District Court for the District of Columbia, four student loan borrowers sued the Department of Education and Secretary Linda McMahon, alleging that the Department was unlawfully refusing to implement the SAVE income-driven repayment plan after the only court injunction blocking it was dismissed on February 27, 2026. The plaintiffs argued that SAVE remains valid law, and that the Department's refusal to process loan discharges, allow plan enrollment, and permit "buyback" of involuntary forbearance periods violated the APA.
