This lawsuit was filed on March 11, 2026 in the U.S. District Court for the District of Columbia by five low-income SNAP recipients residing in Colorado, Iowa, Nebraska, Tennessee, and West Virginia. Plaintiffs brought three APA claims against Brooke Rollins, in her official capacity as Secretary of Agriculture, and the U.S. Department of Agriculture, challenging USDA's approval of state "food restriction waivers" that restrict what SNAP benefits can purchase. Their complaint argued the waivers exceed statutory authority under 7 U.S.C. § 2026, are arbitrary and capricious, and were adopted without the required notice-and-comment process.
