(This summary is temporary while we research the case further). In February 2022, the American Gas Association and other industry groups petitioned the U.S. Court of Appeals for the District of Columbia Circuit for review of a final action taken by the Department of Energy (DOE) which established energy conservation standards for residential furnaces and commercial water heaters. In November 2025, the D.C. Circuit upheld the rule. Plaintiffs filed a cert petition to the Supreme Court and, in an April 2026 brief, the Trump admin asked the Supreme Court to vacate the D.C. Circuit's decision, stating that the rule relied on a "flawed reading" of the statute. On June 8, 2026, the U.S. Supreme Court vacated the District of Columbia Circuit's order and remanded the case.
