On May 6, 2026, a 55-year-old Colombian woman sued Secretary of Homeland Security Markwayne Mullin after the federal government removed her to the Democratic Republic of the Congo despite an immigration judge granting her withholding of removal to Colombia under the Convention Against Torture. The district court initially granted a temporary restraining order requiring the government to facilitate her return. 2026 WL 1352420. In early June, however, the court dissolved the order after the government submitted additional evidence that the Democratic Republic of the Congo had accepted her before her removal; the court concluded that the plaintiff had not made the clear showing that she was entitled to temporary restraining order relief. The court also ordered the plaintiff to show cause why the court should not dismiss the remaining claims for lack of subject matter jurisdiction in light of her pending appeal before the Board of Immigration Appeals.

This case remains ongoing.
