On July 1, 2026, the United States filed this lawsuit in the U.S. District Court for the Eastern District of Virginia against the Commonwealth of Virginia and the Virginia Department of State Police. The United States claimed that SB749, which criminalized the importation, sale, manufacture, purchase, and transfer of assault firearms, including AR-15 style rifles, violated the Second Amendment. They alleged that state enforcement of the ban constituted a pattern or practice of conduct by law enforcement officers depriving Virginians of constitutional rights. The United States asked the court to declare the enforcement unlawful and to preliminarily and permanently enjoin the defendants from enforcing SB749's provisions.
