In February 2026, DHS had fined the plaintiff more than $1.8 million for willfully failing to leave the country after a 2017 removal order. The plaintiff challenged the notice under the Administrative Procedure Act. The plaintiff also claimed the fine was unconstitutionally excessive, that the process violated due process, that DHS ignored a request for the records behind the penalty, and that the agency never proved willfulness.
