On July 10, 2026, marine terminal operators on the Delaware River filed this lawsuit i against the U.S. Army Corps of Engineers and three of its officials in the U.S. District Court for the Eastern District of Pennsylvania. The plaintiffs challenged the Corps' April 2026 reissuance of a Clean Water Act and Rivers and Harbors Act permit allowing a new container terminal near Wilmington, Delaware, including a ship turning basin that would occupy the river's main navigation channel. Plaintiffs alleged that the Corps again failed to independently evaluate the project's effects on navigation and safety and avoided public notice and comment. The same court had vacated the Corps' original approvals for the same project in October 2024 as arbitrary and capricious, and the plaintiffs claimed the reissued approvals repeated the errors the court had previously identified.
