On November 18, 1994, individuals detained in jail after their court-ordered release filed this class-action lawsuit in the U.S. District Court for the Northern District of Illinois. The plaintiffs sued the sheriff of Cook County under 42 U.S.C. § 1983. The plaintiffs alleged that they were detained for ten hours or more while the corrections staff processed the paperwork after their court-ordered release.

The parties settled the case in 1996 and the court approved the settlement on June 27, 1997. The defendants agreed to pay each class claimant $90 to as many as 65,000 people whose release from the jail was delayed more than 10 hours. They had been inmates sometime between Dec. 2, 1992, and Oct. 1, 1996. The defendants also agreed to pay the plaintiffs' attorney's fees and costs, including costs of settlement. The plaintiffs and their attorney initially petitioned for $1,070,955 in attorney's fees and $80,463.76 in costs. They subsequently filed an additional fee petition seeking additional attorney's fees of $106,601.25 and costs of $15,130.54.

On September 29, 1998, the honorable Judge Elaine Bucklo awarded the plaintiffs $344,094.95 in attorney's fees and $92,196.91 in costs. 1998 WL 708803 (N.D. Ill. 1998).
