On January 9, 1992, inmates of the Jackson County Jail in Scottsboro, Alabama, filed a class action lawsuit under 42 U.S.C. § 1983 in the United States District Court for the Northern District of Alabama against the Department of Corrections (DOC) challenging conditions at the jail. The plaintiffs were represented by the Southern Center for Human Rights. On November 7, 1994, the court (Judge Edwin Nelson) entered an order approving and adopting a consent decree and on January 12, 1995, the court entered a permanent injunction against the Department of Corrections, ordering the removal of state prisoners from the jail. A second decree was ordered that year for other county jails. On July 2, 1997, the Attorney General and the Commissioner of the Alabama DOC filed a motion to terminate the consent decrees and the permanent injunction pursuant to the Prison Litigation Reform Act of 1996 (PLRA). On January 27, 1998 the court granted the motion for termination of both decrees and the permanent injunction. The plaintiffs appealed, arguing that the decision to terminate without an evidentiary hearing was unjust and that the termination provisions of the PLRA were unconstitutional.

The United States Court of Appeal for the Eleventh Circuit (Judge Stanley F. Birch, Jr.) reversed and remanded, holding that the Court should have held an evidentiary hearing on the motion to terminate. Loyd v. Alabama Department of Corrections, 176 F.3d 1336 (11th Cir. 1999). The United States Supreme Court denied cert. Loyd v. Alabama Department of Corrections, 528 U.S. 1061 (1999). The docket continues until March of 2000 but no motions of consequence occur after the denial of certiorari.
