Case Summary

This is a case about changes the Postmaster General made to United States Postal Service (USPS) operations.  Fourteen States filed suit against the USPS seeking to reverse those changes already instituted and to block future changes.  The States alleged that the changes made it harder to vote by mail.  They filed their complaint on August 18, 2020, in the U.S. District Court for the Eastern District of Washington.  The case was assigned to U.S. District Judge Stanley Bastian.    The States used…

This is a case about changes the Postmaster General made to United States Postal Service (USPS) operations.  Fourteen States filed suit against the USPS seeking to reverse those changes already instituted and to block future changes.  The States alleged that the changes made it harder to vote by mail.  They filed their complaint on August 18, 2020, in the U.S. District Court for the Eastern District of Washington.  The case was assigned to U.S. District Judge Stanley Bastian.   

The States used the USPS to conduct elections.  They mailed election information, voter-registration cards, and ballots to voters.  They also permitted voters to register and vote by mail, setting deadlines for doing so informed by USPS delivery standards for first-class mail.  In May 2020, during the COVID-19 pandemic and shortly before the November 2020 presidential election, a new Postmaster General was appointed.  He announced changes to USPS operations.  The changes included requiring mail trucks and mail carriers to depart mail-sorting facilities on time even if that resulted in mail left behind, banning extra trips to handle excess or left-behind mail, eliminating overtime, decommissioning mail sorting machines, removing mailboxes, reducing operating hours, and ceasing the USPS’s past practice of treating all electoral mail as first-class mail even if the first-class service rate had not been paid.  

The States alleged that the USPS’s operational changes had led to widespread delivery delays and would lead to future electoral mail would be delayed.  The States also alleged that the changes were intended to suppress mail-in votes where the presidential election was likely to be close.  They pointed to then-President Donald Trump’s statements attacking mail-in voting as rife with fraud.  The States pointed to evidence that mail-in voting fraud was vanishingly rare.

The States brought eight claims against the USPS.  First, they sought a writ of mandamus (pursuant to 28 U.S.C. § 1361) ordering the USPS to seek an advisory opinion from the Postal Regulatory Commission on the effect of its operational changes.  Second, they sought a declaration that (pursuant to 28 U.S.C. § 2201) that the USPS violated 39 U.S.C. § 3661 by making operational changes without first seeking public comment and the Postal Regulatory Commission’s advice.  The States brought five constitutional claims: that the USPS violated (a) the States’ right guaranteed by Article I, Section 4, Clause 1 to set the time, place, and manner of elections; (b) Article II, Section I and the Twelfth Amendment by interfering with the States' chosen methods of appointing presidential electors; (c) the Tenth Amendment by interfering with the manner chosen by the States to elect state officers; (d) their citizens’ constitutional right to vote by burdening that right; and (e) the Fifth Amendment by burdening their citizens’ right to participate equally with other qualified voters in elections.  The States’ eighth claim was that the USPS’s operational changes discriminated against citizens with disabilities by making it harder for them to vote by mail, violating § 504 of the Rehabilitation Act (29 U.S.C. § 794).

As relief (in addition to a writ of mandamus and declaratory judgment), the States sought an injunction (i) prohibiting the USPS from making operational changes before the Postal Regulatory Commission issued an advisory opinion on the effects of the changes; and (ii) requiring the USPS to rescind all such changes already implemented.  The States also sought costs and attorneys’ fees.  

Amicus briefs were filed by the U.S. House of Representatives, the City of Seattle, and joint amici curiae the Brady Campaign to Prevent Gun Violence and “Team ENOUGH.”

On September 9, 2020, the States moved for a preliminary injunction on substantially the same grounds as in their complaint.  They pointed to a decline in timely delivery of first-class mail after the Postmaster General’s changes and to a USPS notice that it would not meet first-class mail delivery standards for electoral mail, unless the States paid for it.  The Court granted the preliminary injunction on September 17, 2020 (487 F. Supp. 3d 976).  It ordered the USPS (1) to stop implementing the Postmaster General’s announced changes; (2) not to make other changes that would “affect service on a nationwide or substantially nationwide basis,” absent an advisory opinion from the Postal Regulatory Commission; (3) to replace or reassemble any mail-sorting equipment that had been destroyed or removed, if necessary to process all electoral mail for the November 2020 election in accordance with first-class mail delivery standards; and (4) to inform all USPS personnel of the court’s order.  The preliminary injunction would remain in effect until entry of final judgment or further order of the court.

On October 2, 2020, the court clarified its order (2020 WL 6588502).  On October 30, 2020, the court ordered the USPS to submit daily reports to the court during the election period (November 1-10, 2020) attesting that all election mail was timely processed.

On December 3, 2020, the USPS filed a notice of appeal of the preliminary injunction with the U.S. Court of Appeals for the Ninth Circuit.  Neither party ever filed a brief.  On January 26, 2021, the Ninth Circuit dismissed the appeal pursuant to the USPS’s unopposed notice of voluntary dismissal (2021 WL 824476).

On February 17, 2021, the court dismissed the States’ action pursuant to their unopposed notice of voluntary dismissal.  The case is closed.
