This case challenged the Nevada Secretary of State's and County Administrators' plan to conduct an all-mail election for the 2020 primary election in response to the Covid-19 pandemic. This case challenged the Nevada Secretary of State's and County Administrators' plan to conduct an all-mail election for the 2020 primary election in response to the Covid-19 pandemic. Three individual residents of Nevada filed suit in the U.S. District Court for the District of Nevada on April 21, 2020.  Plaintiffs sued Nevada's Secretary of State and Washoe County's Registrar of Voters under 42 U.S.C. § 1983, claiming violations under the First and Fourteenth Amendments to the U.S. Constitution, Article 2, § 1 of the Nevada Constitution, Article I, § 4, Clause 1 of the U.S. Constitution and Article IV, § 4 of the U.S. Constitution. Plaintiffs were represented by private counsel and True the Vote, Inc. The case was assigned to Chief Judge Miranda M. Du.

Plaintiffs had five key allegations.  First, the all-mail election limited the right to vote by diluting Plaintiffs' votes with illegal votes.  Second, the all-mail election overruled and replaced the Legislature's chosen manner of election invalidating the Plaintiffs' votes for the representatives who decide the manner of elections.  Third, the all-mail election violated the Purcell Principle because it altered election procedures near the date of the election.  Fourth, the all-mail election was not consistent with the manner of election prescribed by the Legislature.  Fifth, the Secretary of State and County Administrators, through the all-mail election, supplanted the Plaintiffs' elected representatives in exercising powers entrusted entirely to the Legislature.  Plaintiffs sought injunctive and declaratory relief to prevent the Secretary of State and County Administrators from implementing the all-mail election, as well as attorney's fees.

On March 24, 2020, in response to the Covid-19 pandemic, the Secretary of State of Nevada, announced a plan to conduct an all-mail election for the June 9, 2020 Nevada primary election.  The plan was formulated by the Secretary of State and Nevada's 17 county election officials.  Under the plan, all active registered voters would be mailed an absentee ballot for the primary election.  Voters who were registered at their current address did not have to take further action to receive an absentee ballot, but individuals who were not registered or needed to update their registration information were required to do so in order to receive an absentee ballot. Qualified voters were not active had to submit an Absent Ballot Request Form to the County Clerk/Registrar of Voters in the county where they were registered to vote in order to receive an absentee ballot. Under the Clark County's implementation of the plan, inactive voters would be sent absentee ballots and field registrars would collect sealed ballots from voters.

On April 21, 2020, Plaintiffs filed a motion for a preliminary injunction reiterating the allegations in their complaint. 

On April 27, Nevada State Democratic Party, DNC Services Corporation/Democratic National Committee, DCCC, Priorities USA, and John Solomon filed a motion to intervene as defendants.  Intervenor-Defendants argued they satisfied the requirements for intervention as a matter of right, and alternatively, the requirements for permissive intervention.  On April 28, 2020, the court granted the Intervenor-Defendants motion to intervene, finding that Intervenor-Defendants satisfied the requirements for intervention as a matter of right and permissive intervention. 

A hearing on Plaintiffs' motion for preliminary injunction was held on April 29, 2020. On April 30, 2020, the court denied Plaintiffs' motion for preliminary injunction finding the Plaintiffs did not establish a particularized injury to confer standing to assert their claims, as the alleged injury of dilution of votes from election fraud raised by Plaintiffs was an issue raisable by any Nevada voter and Plaintiffs did not show a causal connection between the alleged injury of vote dilution and the all-mail election plan. Additionally, the court found that even if the Plaintiffs established standing, the Plaintiffs failed to establish the merits of each of their claims.  However, the court deferred resolving the merits to provide the Secretary of State time to assert Eleventh Amendment immunity, if chosen to do so.

Following this denial, on May 11, 2020, Defendants filed a motion to dismiss Plaintiff's complaint for failure to state a claim, arguing that the court, in its April 30, 2020 Order denying Plaintiffs' motion for preliminary injunction, already found Plaintiffs failed to establish the merits of each claim and that the Secretary of State had not subsequently asserted Eleventh Amendment immunity. 

On May 13, 2020, Plaintiffs filed an amended complaint and a second motion for preliminary injunction.  The amended complaint added four additional individual voters and Nevada Right to Life as Plaintiffs, added the Registrar of Voters for Clark County as a defendant, and asserted four claims.  First, the all-mail election violated the fundamental right to vote by direct disenfranchisement from the sudden surge in mail-in ballots that would bring late, never-arriving, lost, or delayed ballots, in violation of the First and Fourteenth Amendments to the U.S. Constitution.  Second, the all-mail election violated the fundamental right to vote by vote-dilution disenfranchisement by allowing an influx of illegal votes through the sidestepping of statutory safeguards designed to protect against voting fraud, in violation of the First and Fourteenth Amendments to the U.S. Constitution.  Third, the all-mail election sought to conduct the Primary election in a manner not authorized by the Nevada Legislature and contrary to the Legislature's chosen manner of elections, in violation of Article I, § 4, Clause 1 of the U.S. Constitution. Fourth, Clark County's plan to send mail-in ballots to all registered voters and to allow collection of ballots violated the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution. Plaintiffs' second motion for preliminary injunction reiterated the allegations in their amended complaint.

Subsequently, on May 19, 2020, Intervenor-Defendants filed a motion to dismiss the Plaintiffs amended complaint arguing Plaintiffs lacked standing and failed to state a claim.  As to the standing point, Intervenor-Defendants argued that the disenfranchisement claim could not be connected to the Defendants' decision to proactively mail ballots to voters, that Plaintiffs claim of injury of dilution of votes from election fraud could be raised by any Nevada voter, and that Plaintiffs' claim under the Elections Clause of the U.S. Constitution does not create a private right of action to enforce state law.  As to the failure to state a claim point, Intervenor-Defendants argued that the U.S. Constitution does not provide relief for Plaintiffs claims, and that Plaintiffs claim that Clark County's plan to send mail-in ballots to all voters (inactive and active) and to send county-approved ballot harvesters to collect ballots violated the right to vote and the equal-protection clause of the Fourteenth Amendment was already foreclosed by controlling Ninth Circuit precedent. 

On May 21, 2020, the court found that a hearing on Plaintiff's second motion for preliminary injunction was unnecessary and denied Defendants' motion to dismiss Plaintiffs' first complaint as moot in light of the filing of Plaintiffs' amended complaint.  On May 27, 2020, the court denied Plaintiffs' second motion for preliminary injunction, finding that Plaintiffs still lacked standing to their first three claims, as Plaintiffs' claims could be raised by any Nevada voter and Plaintiffs failed to show that mail-in ballots sent to Nevada voters without requests for absentee ballots would result in direct voter disenfranchisement or disenfranchisement through vote dilution.  Additionally, the court found Plaintiffs were not entitled to equitable relief, as Plaintiffs unreasonably delayed seeking preliminary injunctive relief through their second motion, as they waited fourteen days after the court's first preliminary injunction order and only twenty-six days before the June Primary to file the amended complaint and the second motion for preliminary injunction, and this delay prejudiced Defendants as mail-in ballots had already been sent to many eligible voters. Finally, the court followed the Purcell principle, refusing to alter the mail-in election plan so close to the June primary.

On July 31, 2020, the court dismissed Plaintiffs' case as moot since Plaintiffs could no longer obtain effective relief as the primary election had already occurred on June 9, 2020.
