After Ohio Department of Health ordered the closing of polling places the day before the March primary, the Secretary of State issued a directive to extend absentee voting through June 1 and set June 2 as the date for in-person voting. The Ohio Democratic Party challenged the Secretary of State's authority to set the election date and sought an order to direct the Board of Elections to extend the time for absentee ballot applications and voting, arranging for prepaid postage and return receptacles for absentee ballots, assistance for absentee voters with disabilities or illiteracy, and canvassing of ballots. The Court permitted the Libertarian party to join the complaint. The Court dismissed the Ohio Democratic Party's case at the party's request after the General Assembly passed an act voiding the directive. The Court deemed the Libertarian Party's still pending complaint moot.
