On August 7, 2020, two non-profit organizations, the League of Women Voters of Pennsylvania and the Urban League of Greater Pittsburg, filed this lawsuit with two individual Pennsylvania voters in the U.S. District Court for the Eastern District of Pennsylvania where it was assigned to Judge Petrese B. Tucker. Represented by private counsel, the plaintiffs sued various state election officials. On September 1, 2020, Donald Trump for President, the National Republican Congressional Committee, the Republican National Committee, and the Republican Party of Pennsylvania submitted a motion to intervene as defendants in the case.

The plaintiffs sought declaratory and injunctive relief, claiming that Pennsylvania’s signature verification procedures for mail-in voting unlawfully imposed an undue burden on the right to vote in violation of the First and Fourteenth Amendments, especially during the COVID-19 pandemic. Specifically, the plaintiffs raised concerns that election officials would discard ballots based on arbitrary signature analysis and claimed that the election officials failed to provide timely and reasonable notice and opportunity to cure invalidated absentee ballots.

The Secretary of the Commonwealth of Pennsylvania issued an advisory to county boards of election on September 11, 2020, notifying the election officials that the Pennsylvania election code did not authorize county boards of election to set assigned returned absentee or mail-in ballots based solely on signature analysis by the county boards of the elections. In light of this advisory, the plaintiffs moved to voluntary dismissed the case on September 14, 2020, at which point the defendants had not yet responded to the complaint. The court dismissed the case without prejudice on October 16, 2020, rendering the motion to intervene by various Republican Party entities moot. The case is now closed.
