This is a case about a Protection and Advocacy agency’s (P&A) facilities access authority. On December 16, 1996, Georgia Advocacy Office (GAO), Georgia’s P&A, filed this lawsuit in the U.S. District Court for the Middle District of Georgia. GAO filed this lawsuit against the Director of the Jasper County Department of Family and Children Services under the Protection and Advocacy for Individuals with Mental Illness (PAIMI) Act, with respect to a Jasper County youth facility. Represented by itself, GAO sought declaratory and injunctive relief that Camp violated the PAIMI Act, and that they could access the facility and an individual resident, D.M., who requested legal services from GAO. Camp filed a Motion for Summary Judgment that argued no case or controversy existed. Judge Duross Fitzpatrick presided over the matter.

On May 11, 1998, the court granted the defendants’ Motion for Summary Judgment and dismissed the case. The court reasoned that D.M. stated in an interview with the court that she did not seek legal representation from GAO, and that the PAIMI Act did not cover the facility. GAO appealed this decision to the U.S. Court of Appeals for the Eleventh Circuit. On April 20, 1999, the appellate court upheld the lower court’s judgment, but explained that while the PAIMI Act may cover the facility, no dispute existed because GAO never tried accessing the facility. On June 14, 1999, the court closed the case, and on July 14, 1999, the court sealed the evidentiary record.
