On February 17, 2016, Disability Rights New York (DRNY) filed this lawsuit in the U.S. District Court for the Northern District of New York. DRNY alleged that Northern Rivers Family Services (NRFS), John Henley (in his official capacity as the CEO of NRFS), and Northeast Parent and Child Society (NPCS) violated the Developmental Disabilities Assistance and Bill of Rights (DD) Act, the Protection and Advocacy for Individuals with Mental Illness (PAIMI) Act, and the Protection and Advocacy of Individual Rights (PAIR) Program, when NPCS, which is managed by NRFS, refused to provide access to facilities and records for purposes of investigating abuse and neglect. Judge Hon. Glenn T. Suddaby presided over this matter.

This lawsuit began after DRNY determined that it had probable cause to investigate the possible abuse and/or neglect of individuals with disabilities upon receiving complaints concerning two youth residents of the Children’s Home Residential Treatment Center. DRNY obtained signed authorizations from the residents’ guardians that allowed NPCS and NRFS to release the residents’ records to DRNY. NPCS and NRFS denied DRNY’s requests to access the facility for investigation and monitoring purposes and to access records pertaining to the alleged abuse and/or neglect, asserting that the youths were not individuals with developmental disabilities and were not involved in programs for people with developmental disabilities.

On March 17, 2016, NPCS and NRFS filed a motion to dismiss the complaint for failure to state a claim. On April 11, 2016, DRNY filed a response in opposition to the motions to dismiss the complaint.

On June 2, 2016, the court granted the motion for a preliminary injunction, enjoining the defendant from precluded reasonable access and denying access to records, and denied the motions to dismiss the complaint.

On July 21, 2016, the court approved a consent decree negotiated by the parties. The decree stated that DRNY would have access to the facility and the records, and that the lawsuit would be dismissed without prejudice. Each party bore its own attorney fees and litigation costs. The case is now closed.

TEXT ORDER denying #4 Plaintiff's application for an Order to Show Cause. Plaintiff has not established the requirement for the issuance of an Order to Show Cause under Local Rules 7.1(e). More specifically, Plaintiff has not submitted an affidavit clearly and specifically showing good and sufficient cause why the standard Notice of Motion procedure cannot be used with regard to its Motion for a Preliminary Injunction. N.D.N.Y. L.R. 7.1(e). Nor has Plaintiff even demonstrate[d], in a detailed and specific affidavit, good cause and substantial prejudice that would result from requiring Plaintiff to give Defendants reasonable advanced notice of its application for an Order to Show Cause. N.D.N.Y. L.R. 7.1(e). Rather, Plaintiff has submitted the "affidavit" of its counsel. (Dkt. No. 4, Attach. 1.) As an initial matter, the "affidavit" is neither notarized nor verified pursuant to 28 U.S.C. § 1746. (Id.) Moreover, generally, counsel are not competent to testify as to the prejudice his or her client would suffer from having to give an opponent reasonable advanced notice of an application for an Order to Show Cause. Road Dawgs Motorcycle Club of the U.S., Inc. v. Cuse Road Dawgs, Inc., 679 F. Supp.2d 259, 281-82 & n.54 (N.D.N.Y. 2009). In any event, the "affidavit" does not address the urgency of injunctive relief or difficulty of regular service, but merely the merits of the request for injunctive relief. Indeed, it acknowledges that Plaintiff's clients are "former residents of defendants' facility." (Dkt. No. 4, Attach. 1, 4 [emphasis added].) The declaration of Plaintiff's client, proffered in support of its motion for a preliminary injunction, does not cure these defects. (Dkt. No. 4, Attach. 3.) Decision is reserved on Plaintiffs motion for a preliminary injunction. Plaintiff shall serve on Defendants a copy of its Complaint, its motion for a preliminary injunction, and this Text Order, and promptly thereafter file a Certificate of Service with the Court. Defendants shall file with this Court, and serve on Plaintiff's counsel, their response to Plaintiffs motion for a preliminary injunction within FOURTEEN (14) DAYS of the aforementioned service. Defendants are also preliminarily enjoined from denying Plaintiff the following, so that Plaintiff may exercise its incident-investigation function in accordance with the DD Act and/or the PAIMI Act (and their implementing regulations): (1) access to the records of R.W. and T.H. that were prepared or received by staff at the Children's Home; and (2) the reasonable opportunity to interview any resident or employee of the Children's Home who might be reasonably believed by Plaintiff to have knowledge of the incident(s) under investigation (i.e., the incidents involving R.W. and/or T.H.).
