MEMORANDUM and ORDER Defts' motion pursuant to FRCP 12 (b)(1) to dismiss the complaint in respect to DeMarco is granted. In respect to the Clinic, the Court declares that the Clinic has standing in both its representational and individual capacities. In respect to the First and Second Causes of Action, the Court does not reach the issue of the constitutionality of OMH's alleged practice. Defts' motion pursuant to FRCP 12(b)(6) to dismiss the Third and Fourth Causes of Action, asserting the violation of Brown and Rothstein's constitutional rights because they were allegedly assessed full care and treatment charges in retailation for the filing of their lawsuits in the State Suprmeme Court, is denied. In respect to the Fifth and Sixth causes of Action, the Court declares that the collection of care and treatment charges by OMH under Mental Hygiene Law are not preempted under 42 USC sec. 1983 or 42 USC sec. 10801.
