This is a case about whether a Protection and Advocacy (P&A) agency’s records access authority includes security camera footage.

On June 30, 2021, Disability Rights Texas, Texas’s P&A, filed this lawsuit in the U.S. District Court for the Northern District of Texas. Disability Rights Texas filed this lawsuit against Ricky Bishop in his official capacity as Sheriff of Taylor County, Texas under the Protection and Advocacy for Individuals with Mental Illness Act. Represented by itself, Disability Rights Texas sought injunctive and declaratory relief that the County violated the PAIMI Act when they refused to provide plaintiffs with video footage requested under its PAIMI Act records access authority. Judge James Wesley Hendrix presided over this matter.

This case began after the County refused to provide Disability Rights Texas with security camera footage of an individual’s mechanical restraint at a County operated detention center. The County argued that P&A’s PAIMI Act authority did not include video footage, or records that were not directly related to an individual’s treatment or care.

In July 2022, the court granted Disability Rights Texas’s Motion for Summary Judgment. The court explained that videos were considered records under the PAIMI Act. Moreover, the court determined that P&As may receive all records of any individual under the PAIMI Act, and this included video records that were not taken in direct relation with the individual’s care or treatment. Therefore, the P&A could access security camera footage under the PAIMI Act. The court issued a preliminary injunction that required the County provide Disability Rights Texas with the records requested, and a permanent injunction for future records requests made by the P&A under the PAIMI Act. In September 2022, Disability Rights Texas filed a Motion for Attorneys’ Fees. On March 21, 2023, the court awarded $545.50 in costs and reasonable and necessary attorneys' fees of $43,440. The County appealed the award to the U.S. Court of Appeals for the 5th Circuit, but, on August 21, 2023, reported that the parties had settled on that issue and voluntarily dismissed the appeal.  The case is now closed.
