On March, 27 1987, a handicapped child, through his next friend, filed a civil rights lawsuit in the U.S. District Court Southern District of Florida, challenging the conditions of confinement at the Broward County Regional Juvenile Detention Center. Plaintiff sought declaratory and injunctive relief, as well as class certification. Plaintiff alleged overcrowding, lack of security, unsanitary conditions, inadequate health care and infliction of abusive punishment. Plaintiff also brought claims for lack of special education programs for handicapped children.

Defendants moved to dismiss plaintiff's First Amended Complaint. The District Court (Judge Jose A. Gonzalez, Jr.) held that plaintiff could state a claim under Section 504 (Rehabilitation Act), 29 U.S.C. § 701 and the Education of All Handicapped Children Act , 20 U.S.C. § 1400 (EHA) but that plaintiff failed to allege that he exhausted his administrative remedies prior to suit. The Court granted defendants' motion to dismiss, but granted plaintiff leave to file an amended complaint. G.C by and through W.S. v. Coler, 673 F.Supp. 1093 (S.D.Fla. 1987).
