Case Summary

In approximately 1975, inmates at Hawaii Youth Correctional Facility filed a class action lawsuit in the U.S. District Court for the District of Hawaii against the Facility on behalf of present and future juveniles at the facility. The plaintiffs, represented by Legal Aid Society of Hawaii, alleged unconstitutional denial of their access to counsel and due process in the courts.

On September 18, 1975, the parties entered into a Settlement Agreement, stating that the juveniles had a right to legal counsel and outlining procedures to guarantee that access. They included the times of day when inmates could consult with their attorneys through meetings and unmonitored phone calls, and the permission for paralegals to confer with inmates on behalf of the inmate's attorneys. We have only the settlement agreement and therefore have no further information on this case.
