On October 28, 2004, the Democratic National Committee (“DNC”) filed this complaint to reopen this case and seek preliminary and permanent injunctive and declaratory relief against the Defendant Republican National Committee (“RNC”). 

Judge Dickinson R. Debevoise of the United States District Court for the District of New Jersey previously entered two Consent Decrees and an Order to restrain the ballot security and ballot integrity activities of the RNC after the committee sent out mass mailings to registered voters and used undelivered and returned letters to compile voter challenge lists. Those included on the lists were removed from voter rolls without knowledge of whether they still resided within the same voting precinct. Despite RNC’s assertions that the ballot security measures were done to combat vote fraud, the actions had the effect of suppressing legitimate African American votes. The DNC alleged violations of the Voting Rights Act (VRA) and Fourteenth and Fifteenth Amendments. The Court’s Consent Decrees mandated that the RNC request and receive approval from the Court before it “assists or participates in” any additional ballot security efforts and that any such efforts must not “use nor appear to use, racial, or ethnic criteria in connection with ballot integrity, ballot security, or other efforts to prevent or remedy suspected vote fraud.”


Notwithstanding the Decrees, the DNC produced evidence that the RNC took part in another mass mailing ballot security program that created a voter challenge list of 35,000 Ohio registered voters. These efforts were not approved by the Court prior to implementation. This list affected African American voters disproportionately and failed to show how the individuals listed were unqualified to vote. The DNC argued that the list overwhelmed the ability of Ohio election officials to adjudicate the challenges, while confusion and delays would further cause primarily African American voters to be deprived of their right to vote.


Two newly registered voters, included on the voter challenge list, were intervenors of this case and sought to enforce the instated Consent Decrees as intended beneficiaries. Represented by private firms and the Advancement Project, the intervenors urged the Court to 1) declare the ballot security efforts lacked Court approval, 2) preliminarily enjoin any challenges by the RNC or any organization acting in concert with it based on any ballot security efforts (until approved by the Court), 3) award reasonable attorneys’ fees, litigation expenses, and costs pursuant to 42 U.S.C. §1973l(e) and §1988, and 4) grant other relief as may be just. 


On October 28, 2004, the Plaintiff’s side proceeded to motion for a preliminary injunction alongside the aforementioned complaint. The intervenors sought to intervene in and reopen this case on an emergency basis under Fed. R. Civ. P. Rules 71 and 24. On November 1, 2004, a motion hearing was held that resulted in an order enjoining and restraining the RNC from using the original list of 35,000 individuals for voter challenge purposes. The RNC subsequently appealed from the aforesaid order. 


The United States Court for the Third Circuit (USCA) proceeded to rehear the RNC’s petition, while simultaneously vacating the November 1 order. On November 9, the USCA having found ample support for the factual findings of the District Court, released an opinion that denied the RNC’s emergency motion for a stay pending appeal. Ensuingly, the parties agreed to a joint stipulation of dismissal that was signed by Judge  Debevoise on February 3, 2005. 


That following November, the DNC moved for a preliminary injunction and motioned for an order to show cause. On the same day, November 3, 2008, the organization “Obama for America” simultaneously motioned to intervene. After the submission of a brief by the defendant that motioned to vacate or modify the Consent Decree and a successive post hearing brief of opposition by the plaintiff, Judge Debevoise rendered an opinion and order on December 1, 2009. While the opinion denied the RNC’s motion to vacate the Consent Decree, it modified the decree as follows: 

  1. Only the parties to the Consent Decree may bring suit to redress a violation of the agreement.
  2. The preclearance period is shortened from 20 to 10 days. The RNC shall be required to notify the DNC and Court of any proposed ballot security measures at least 10 days before instituting such measures so that this Court may determine their legality and whether they comply with the other terms of the Consent Decree.
  3. Ballot security” shall include any program aimed at combating voter fraud by preventing potential voters from registering to vote or casting a ballot. This includes, but is not limited to, the compilation of voter challenge lists by use of mailings or reviewing databases maintained by state agencies such as motor vehicle records, social security records, change of address forms, and voter lists assembled pursuant to the HAVA; the use of challengers to confront potential voters and verify their eligibility at the polls on either Election Day or a day on which they may take advantage of state early voting procedures; the recording by photographic or other means of voter likenesses or vehicles at any polling place; and the distribution of literature informing individuals at or near a polling place that voter fraud is a crime or detailing the penalties under any state or federal statute for impermissibly casting a ballot.
  4. A “normal poll-watch function” shall include stationing individuals at polling stations to observe the voting process and report irregularities unrelated to voter fraud to duly-appointed state officials. Such observers may report any disturbance that they reasonably believe might deter eligible voters from casting their ballots, including malfunctioning voting machines, long lines, or understaffing at polling places. Such observers may not question voters about their credentials; impede or delay voters by asking for identification, videotape, photograph, or otherwise make visual records of voters or their vehicles; or issue literature outlining the fact that voter fraud is a crime or detailing the penalties under any state or federal statute for impermissibly casting a ballot.
  5. The Consent Decree shall not apply to any initiative undertaken by the RNC that does not have as at least one of its purposes the prevention of either fraudulent voting or fraudulent voter registration.  Such programs include any effort undertaken by the RNC, or by any state or local Republican entity with which it coordinates, to increase the number of individuals that cast a ballot in any election, including registering voters pursuant to applicable state statutes or encouraging voters to visit the polls (“get out the vote”) on either Election Day or a day on which they may take advantage of state early voting procedures.
  6. The Consent Decree shall expire (and the entirety of its terms shall become null and void) on December 1, 2017, eight years after the modification date. If during the period, the DNC proves by a preponderance of the evidence that the RNC has violated the terms of the Consent Decree, the decree shall be extended for 8 years from the date of that violation.

Eight days after the aforementioned opinion and order, the RNC appealed. The USCA’s next judgment was rendered on March 8, 2012. The accompanying mandate affirmed the December 1, 2009 order of the District Court and instructed the parties to bear their own costs. 

Thereafter, the case was reassigned to Judge John Michael Vazquez on October 27, 2016. Upon reassignment, Judge Vazquez directed the clerk of court to reopen the matter and set forth a briefing schedule.


Less than one month later, on November 5, 2016,  the civil case was terminated. A forthcoming order was released that denied the DNC's motions for a preliminary injunction, to hold the RNC in contempt, and to extend the Consent Decree (beyond the original end date for the 8 year deadline). One year later, on December 1, 2017, the court officially terminated the 1982 Consent Decree and the 2009 modified version and instructed the clerk of court to close the matter.


The DNC appealed on January 31, 2018. The USCA released a mandate on January 29, 2019 that affirmed the prior orders of the District Court that were entered into on October 31, 2016, November 2, 2016, November 5, 2016, January 4, 2017, July 7, 2017, September 29, 2017, November 29, 2017, and January 9, 2018. 

The final entry, dated January 30, 2019, states: “Pursuant to Local Rule 79.4, notice is hereby given of the Appellate ruling filed on January 7, 2019. In the event that the mandate or judgment provides for costs or directs a disposition other than an affirmance, the prevailing party shall prepare and submit an order implementing the mandate or judgment.”
