On February 3, 2022, two individuals in the custody of the Federal Bureau of Prisons filed a putative class-action lawsuit in the U.S. District Court for the District of Columbia against the Federal Bureau of Prisons and the U.S. Attorney General of the Department of Justice. Represented by public defenders, the plaintiffs sued on behalf of themselves and other people who were sentenced by the D.C. Superior Court, serving sentences for violations of D.C. code, and held in the custody of the Federal Bureau of Prisons, as well as those who would be in the future. The suit revolved around the validity of the procedures used by the Bureau of Prisons to determine "criminal history scores," which determined many aspects of incarceration. Scores affected individuals' security classifications, the levels of prison in which they were placed, and their eligibility for home confinement and half-way houses.

The plaintiffs alleged that the two systems used by the Bureau of Prisons to calculate these "criminal history scores" violated the Administrative Procedure Act as well as the Equal Protection Clause of the U.S. Constitution due to their disparate outcomes. The Bureau of Prisons used one system for people sentenced in federal court and another for people sentenced in all other courts, such as military courts, state courts, and D.C. courts. The plaintiffs alleged that the system of calculation used by D.C. Superior Court yielded higher criminal history scores than the federal court system, thus placing some individuals in higher security prisons, with less programming and a higher risk of violence than if they had been sentenced in federal court. The plaintiffs also alleged that the discrepancies between the systems disproportionately affected Black people, noting that when they filed their complaint, over 95 percent of people sentenced by the D.C. Superior Court and in the custody of the Bureau of Prisons were Black. Contrarily, the majority of individuals sentenced by federal courts in the custody of the Bureau of Prisons were white. The plaintiffs sought declaratory and injunctive relief.

As of February 12, 2022, the case is ongoing.
