Bassi (Defendant's Attorney from Hortman, Harlow, Robinson & McDaniel, PLLC).

Harold J. Blakely sought judicial review and an injunction to have his name placed on the ballot for the upcoming primary election for the position of city councilman in Laurel, Mississippi. Blakely argued that his disqualification based on alleged felony convictions was a violation of his voting rights. He claimed that he had not been convicted of any disqualifying felonies and that the defendants had acted unlawfully in preventing him from running for office.

Blakely filed a motion for a preliminary injunction to prevent the defendants from disqualifying him from the election. The court held a hearing on this motion, during which evidence and arguments were presented by both parties. The defendants argued that Blakely had been convicted of three felonies, which disqualified him from running for public office under Mississippi law. The court found that Blakely had indeed been convicted of felonies and that his claims were barred by the doctrine of res judicata, as he had previously filed similar lawsuits that were dismissed.

The court dismissed Blakely's complaint with prejudice, finding it frivolous and malicious. The court also imposed a $5,000 sanction against Blakely, to be paid to the defendants, and assessed him with the costs of the litigation, including the original filing fee and costs for service of process. The court relied on Mississippi Code Annotated §23-15-309, which disqualifies individuals with felony convictions from running for public office unless pardoned and noted that Blakely had not been pardoned for his convictions. The court also referenced the Voting Rights Act, stating that the statutes in question predated the Act or had been precleared, and thus there was no violation of the Act. Blakely's appeal of the District Court's order was dismissed by the Fifth Circuit Court as frivolous.
