On May 7, 2012, the California Justice Committee, the Constitution Party of California, and three registered California voters (jointly “California Justice Committee et al.”) filed this lawsuit in the United States District Court for the Central District of California.  California Justice Committee et al. sued the California Secretary of State under 42 U.S.C. § 1983.  Represented by the ACLU Foundation of Southern California, California Justice Committee et al. sought preliminary and permanent injunctive relief prohibiting enforcement of California’s party-qualification scheme for political bodies wishing to qualify as recognized political parties for the California general election.  They claimed that California’s Elections Code § 5100 imposed an unreasonably early deadline—officially 135 days before the June primary, but effectively 154 days—for new political parties to qualify if they wished only to place their presidential and vice-presidential nominees on the November 2012 ballot, and that this early deadline unconstitutionally burdened the associational and voting rights of minor parties and their supporters.  They also sought declaratory relief that this scheme was unconstitutional and attorney’s fees.  The case was assigned to United States District Judge Percy Anderson.

California’s Elections Code § 5100 provided three avenues by which political parties could receive formal recognition in California.  Cal. Elec. Code § 5100.  Because the California Justice Party and the Constitution Party of California had limited funds, its supporters elected to seek qualification as a political party in California under § 5100(b)—by having 1 percent of the vote from the last gubernatorial election declare their intent to affiliate with the party by registering with the party. Id.  Elections Code § 5100 required the Secretary of State to decide which parties were eligible to participate in the primary election 135 days before the primary date.  However, for political bodies seeking to qualify under Elections Code § 5100(b) (voter registration), the Secretary of State’s determination was based on voter registration affidavits submitted to each county’s registrar of voters by 154 days before the primary.  Cal. Elec. Code § 2187(d)(2).  Under California law, presidential and vice-presidential candidates did not need to participate in the primary election to participate in the general election.  Cal. Const., art. 2, § 5(a-b); Cal. Elec. Code § 359.5.  

In January 2012, the Secretary of State determined that the California Justice Party and Constitution Party of California failed to qualify as recognized political parties by the 135-day deadline.  The California Justice Committee et al. contended that § 5100’s requirement violated their First and Fourteenth Amendment rights to associate for the advancement of political beliefs and the rights of qualified voters to cast their votes effectively in the general election.

Along with their complaint, the California Justice Committee et al. filed a motion for a preliminary injunction on May 7, 2012.  On May 21, 2012, Judge Anderson granted the preliminary injunction without oral argument.   He enjoined the Secretary of State from enforcing the 135‑day‑before‑the‑primary requirement against new political parties that sought only to qualify for the November 2012 general election ballot.  2012 WL 2861349.

Both parties submitted trial briefs and contentions of fact.  The case proceeded on the merits and Judge Anderson held a bench trial on October 16, 2012.

On October 18, 2012, Judge Anderson entered judgment in favor of California Justice Committee et al. The court concluded that California’s requirement that new political parties qualify 135 days before the primary election in order to place its presidential and vice-presidential candidates in the general election imposed a severe and unconstitutional burden on their First and Fourteenth Amendment rights, particularly in light of how rarely new parties had been able to qualify under it and the fact that independent candidates could be included in the general election ballot by a 98-day deadline. The court held that the state’s interests in administrative efficiency, preventing confusion or fraud, and ensuring “bona fide” parties did not justify such an early cutoff, especially given evidence that a significantly later date (around June 30) is administratively workable and already used for independent presidential candidates.  The court granted declaratory and permanently injunctive relief, enjoining the Secretary of State from enforcing or otherwise applying California Elections Code section 5100’s requirement that proposed political parties must satisfy the party qualification requirements at least 135 days prior to the primary election.  2012 WL 5057625.

On October 26, 2012, the Secretary of State filed an unopposed motion to amend the judgment to clarify the scope of the permanent injunction.  The Secretary of State requested that the court amend the permanent injunction to clarify that “[T]he Secretary of State is permanently enjoined from enforcing or otherwise applying California Elections Code section 5100’s requirement that proposed political parties that wish to qualify as political parties in order to participate in a November presidential general election must satisfy the party qualification requirements at least 135 days prior to the primary election.” (emphasis in original).

On November 15, 2012, the parties reached a settlement whereby the Secretary of State agreed to pay California Justice Committee et al. $70,000 in attorney’s fees.

On November 29, 2012, Judge Anderson granted the Secretary of State’s motion to amend the judgment.

The case is closed.

MINUTES OF IN CHAMBERS - COURT ORDER by Judge Percy Anderson: The Court grants Plaintiffs' Motion for Preliminary Injunction 16 . The Secretary of State is enjoined from enforcing against Plaintiffs the requirement in California Elections Code sections 5100(b) and 5100(c) that Plaintiffs must satisfy the party-qualification requirements at least 135 days prior to the primary election. Because Plaintiffs have requested that the Court issue the injunction without the posting of a bond, and the Secretary of State has not opposed that request, the Court concludes that no bond is necessary. In issuing this injunction, the Court declines, on this record, to impose an alternative deadline in advance of the November general election by which Plaintiffs must satisfy the numerosity requirements of sections 5100(b) or 5100(c). However, Plaintiffs do not have an unlimited amount of time to qualify for the November general election. Nothing in this Order precludes the Secretary of State from establishing an alternative deadline prior to the November general election. Nor does this Order alter or otherwise modify any other deadline related to the certification and preparation of election and ballot materials for the November general election contained within the California Elections Code or established by the Secretary of State. IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that California Elections Code section 5100's timing requirement violates Plaintiffs' rights under the First and Fourteenth Amendments of the United States Constitution. IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that the Secretary of State is permanently enjoined from enforcing or otherwise applying California Elections Code section 5100's requirement that proposed political parties must satisfy the party qualification requirements at least 135 days prior to the primary election.
