As of 2018, Georgia state law allowed absentee ballots to be rejected in instances where ballot signatures did not match signatures on file. In these cases, no notice was provided prior to the rejection and no appeals process was in place. This led two civic organizations to sue then-Georgia Secretary of State Brian Kemp on October 16, 2018, in the U.S. District Court for the Northern District of Georgia with the ACLU as counsel. The plaintiffs brought the suit in the hopes of an injunction to prevent ballot rejections without proper notice and establishing an identity verification process. The suit was grounded in claims that the state procedures were violative of the Due Process and Equal Protection Clauses of the Fourteenth Amendment. Specifically, the plaintiffs sought a ruling declaring the pertinent Georgia state laws unconstitutional and requested a temporary restraining order, preliminary injunction, and permanent injunction against these state laws.

On October 17, 2018, the plaintiffs filed a motion for a temporary restraining order that would halt absentee ballot rejections on these grounds. Judge Leigh Martin May granted the motion on October 24, 2018, 341 F. Supp. 3d 1326, and signed the temporary restraining order the next day. In her opinion, Judge May explained that the existing absentee vote system did not provide adequate process for voters in accordance with their constitutional rights.

An emergency motion for stay pending appeal of preliminary injunction was filed on October 25, 2018, but was denied by Judge May on October 30, 2018. On October 26, 2018, the defendants appealed the preliminary injunction to the U.S. Court of Appeals for the Eleventh Circuit. The plaintiffs submitted an amended complaint that updated the listed plaintiffs. Additionally, the plaintiffs added class action allegations on October 29, 2018 as an alternative in case the court required class certification. A few days later, on November 2, 2018, the Eleventh Circuit denied the aforementioned appeal.

However, the parties ultimately agreed to end litigation on April 15, 2019, following the passage of HB 316. This bill altered multiple aspects of the state laws governing absentee ballots, including permission to reject an absentee ballot due to "apparent mismatch." This case is now closed.
